What Washington Organizations Need to Know

Washington’s Electronic Product Recycling Law establishes E-Cycle Washington for covered electronic products and covered entities. The law’s small-business category is limited to businesses with fewer than 50 employees, and coverage also depends on the type of equipment. Medium and large organizations, high-volume projects, non-covered equipment, and projects requiring verified data services or detailed reporting need an appropriate commercial ITAD or electronics recycling process.

Recommended Actions for Commercial Organizations

Determine which equipment is being retired, which devices contain data, and which internal, contractual, industry, or regulatory requirements apply.
Use a certified commercial ITAD provider when the project requires secure logistics, serialized inventory, verified sanitization or destruction, responsible recycling, or formal documentation.
Maintain custody records, asset-level inventories, and final disposition documentation that meet internal audit, insurance, customer, and regulatory requirements.
Treat every data-bearing device as a security asset until its sanitization or physical destruction has been verified and documented.

Washington Data Breach and Record Disposal Considerations

When notification is required, Washington law generally requires affected consumers to be notified as expediently as possible, without unreasonable delay, and no more than 30 calendar days after discovery, subject to statutory exceptions. A business required to notify more than 500 Washington residents must also notify the Washington Attorney General no more than 30 days after discovery. See RCW 19.255.010. Washington also regulates the disposal of records containing certain personal information under RCW 19.215.020, reinforcing the need for defensible media disposition and documentation.

Important compliance distinction. A state recycling program or disposal rule does not, by itself, satisfy an organization’s data-security, privacy, contractual, retention, or audit obligations. A complete ITAD process addresses both the physical asset and the information stored on it.
